1. Purpose

These Terms of Use define the terms and conditions for using the Reminiscio mobile application and online service, referred to as the Service, published by Telly D., an individual acting in a non-professional capacity, referred to as the Publisher.

Use of the Service implies full acceptance of these Terms of Use. If you do not accept these terms, please do not use the Service.

2. Service Description

Reminiscio is an application that lets users create, organize, share and view a personal timeline of their memories. The Service notably allows users to:

• Create and publish memories as text, photos or audio associated with dates, categories and places
• Add photos, audio files, captions and metadata to their memories
• Organize memories in a chronological timeline
• View and search their memories
• Choose the visibility of certain memories, including private visibility or visibility to friends
• Interact with other users through friend requests, comments, reactions, notifications and private messages
• Create temporary public links to share a non-audio memory
• Use assistance features, such as audio transcription, when the user chooses to use them

3. Registration and User Account

3.1 Account creation

Access to the Service requires the creation of a user account. Registration and login may be completed through a third-party identity provider, including Google or Apple, or through a login link sent by email. The user guarantees the accuracy of the information provided during registration.

3.2 Account security

The user is responsible for keeping their login credentials confidential and for any activity carried out from their account. In the event of unauthorized use, the user must inform the Publisher without delay.

3.3 Minimum age

The Service is intended for people aged 16 or older. Use of the Service by a minor under 16 requires the consent of a legal representative, who may contact the Publisher for any question related to the minor's account.

4. Use of the Service

4.1 Rules of conduct

The user agrees to:

• Not publish unlawful, defamatory, insulting, obscene content or content that infringes third-party rights
• Not use the Service for unauthorized commercial purposes
• Not attempt to bypass the Service's security measures
• Not collect data from other users without their consent
• Respect third-party intellectual property rights

4.2 User content

The user retains all intellectual property rights in the content they publish or transmit through the Service, including text, photos, audio, comments, reactions and messages. By publishing or transmitting content, the user grants the Publisher a non-exclusive, worldwide and free license to host, store, process, display and transmit this content solely for the purpose of providing the Service.

4.3 Visibility and sharing

Some content may be visible only to the user, to their friends, or to anyone with a temporary public link created voluntarily by the user. The user is responsible for choosing the visibility of their content and for sharing generated links.

4.4 Integrated third-party services

Some features rely on third-party services, notably for authentication, sending emails, media storage, location, push notifications and audio transcription. Their use is limited to what is necessary for the Service to operate.

4.5 Content moderation

To prevent abuse, unlawful or fraudulent content, or content that violates these Terms of Use, the Publisher may manually review content published or uploaded to the Service, notably photos. This review is limited to moderation, security, support or legal compliance needs.

The Publisher may refuse, hide, delete or restrict access to any content that is manifestly unlawful, abusive, fraudulent, infringes third-party rights or violates these Terms of Use.

5. Intellectual Property

All elements of the Service, including the logo, interface, text, code and design, are the exclusive property of the Publisher and are protected by intellectual property law. Any unauthorized reproduction, modification or exploitation is strictly prohibited.

6. Liability

6.1 Limitation of liability

The Service is provided as is. The Publisher makes reasonable efforts to ensure the availability and proper operation of the Service but does not guarantee uninterrupted availability. The Publisher cannot be held liable for indirect damages resulting from use of the Service.

6.2 Force majeure

The Publisher cannot be held liable in the event of force majeure, including technical failures, network interruptions or natural disasters.

7. Suspension and Termination

The Publisher reserves the right to suspend or delete a user account in the event of a violation of these Terms of Use, without prior notice. The user may delete their account at any time from the application settings, resulting in the deletion of their personal data in accordance with our privacy policy.

8. Changes to the Terms

The Publisher reserves the right to modify these Terms of Use at any time. Users will be informed of any substantial change. Continued use of the Service after a change constitutes acceptance of the new terms.

9. Applicable Law and Jurisdiction

These Terms of Use are governed by French law. In the event of a dispute, the parties agree to seek an amicable solution before any legal action. Failing that, the competent courts will be determined in accordance with applicable legal rules.
