Terms of Use

1. Purpose

These Terms of Use define the terms and conditions for using the Reminiscio mobile application and online service, referred to as the Service, published by Telly D., an individual acting in a non-professional capacity, referred to as the Publisher.

Use of the Service implies full acceptance of these Terms of Use. If you do not accept these terms, please do not use the Service.

2. Service Description

Reminiscio is an application that lets users create, organize, share and view a personal timeline of their posts. The Service notably allows users to:

• Create and publish posts as text, photos, audio recordings or videos associated with dates and places
• Add photos, audio or video files, captions and metadata to their posts
• Organize posts in a chronological timeline
• View and search their posts
• Choose the audience of each post: only the user, their friends, a group or, for non-audio posts, the public
• View, in the Discover feed, posts made public by users who are not their friends, as well as their public profile
• Interact with other users through friend requests, comments, reactions, notifications and private messages
• Block a user and report a post, a comment or a user
• Create temporary public links to share an individual non-audio post or a journey; a shared journey may include audio and video posts
• Use assistance features, such as audio transcription, when the user chooses to use them

3. Registration and User Account

3.1 Account creation

Access to the Service requires the creation of a user account. Registration and login may be completed through a third-party identity provider, including Google or Apple, or through a login link sent by email. The user guarantees the accuracy of the information provided during registration.

3.2 Account security

The user is responsible for keeping their login credentials confidential and for any activity carried out from their account. In the event of unauthorized use, the user must inform the Publisher without delay.

3.3 Minimum age

The Service is intended for people aged 16 or older. Use of the Service by a minor under 16 requires the consent of a legal representative, who may contact the Publisher for any question related to the minor's account. Before making a post public for the first time, the user must confirm that they are 16 or older.

4. Use of the Service

4.1 Rules of conduct

The user agrees to:

• Not publish unlawful, defamatory, insulting, obscene content or content that infringes third-party rights
• Not harass, threaten or impersonate other users, or incite hatred or violence
• Not publish photos or videos of an identifiable person without their permission, or of a minor without the permission of their legal representatives
• Not use the Service for unauthorized commercial purposes
• Not attempt to bypass the Service's security measures
• Not collect data from other users without their consent
• Respect third-party intellectual property rights

4.2 User content

The user retains all intellectual property rights in the content they publish or transmit through the Service, including text, photos, audio, videos, comments, reactions and messages. By publishing or transmitting content, the user grants the Publisher a non-exclusive, worldwide and free license to host, store, process, display and transmit this content solely for the purpose of providing the Service.

4.3 Visibility and sharing

Each post is visible to the audience chosen by the user: only themselves ("Only me", the default audience), their friends, a group or the public. Some content may also be viewed by anyone with a temporary public link created voluntarily by the user. The user is responsible for choosing the visibility of their content and for sharing generated links.

The "Public" audience is never applied by default. A public post is visible to every user signed in to a Reminiscio account, including people who are not friends with its author, notably in the Discover feed and on the author's public profile. It cannot be accessed without an account and is not indexed by search engines. Audio posts cannot be made public. The first time a post is made public, the user confirms that they understand this audience and that they are 16 or older.

The Discover feed shows public posts from users who are not friends with the viewer, from the most recently made public to the oldest, without any recommendation algorithm. For a public post, these users see the media, text, caption, the date associated with the post, city and country, the author's name, username and profile picture, and the number of reactions. They do not see the precise location, the place label, the associated journey or the comments. They may react with an emoji; comments and mentions remain reserved for the author's friends and members of the relevant group.

A user's public profile only shows their name, username, profile picture and public posts.

The user may at any time choose another audience for a public post or delete it. The post then immediately disappears from the Discover feed and the public profile. Media access links issued for public display expire no later than one hour after they are issued. Temporary sharing links remain managed separately by the user. The Publisher cannot control copies, screenshots or recordings made by third parties while the post was public.

4.4 Integrated third-party services

Some features rely on third-party services, notably for authentication, sending emails, media storage, location, push notifications, audio transcription, error and performance monitoring, and mobile purchase infrastructure. Their use is limited to what is necessary for the Service to operate.

4.5 Content moderation

To prevent abuse, unlawful or fraudulent content, or content that violates these Terms of Use, the Publisher may manually review content published or uploaded to the Service, notably photos and videos. This review is limited to moderation, security, support or legal compliance needs.

The Publisher may refuse, hide, delete or restrict access to any content that is manifestly unlawful, abusive, fraudulent, infringes third-party rights or violates these Terms of Use.

Moderation takes place after publication: content is not subject to prior approval before it is published.

The Publisher applies zero tolerance to objectionable content and abusive users: any content or behavior that violates these Terms of Use may result in the removal of the content and the suspension or deletion of the account concerned. Reports are handled as promptly as possible.

4.6 Blocking

The user may block another user. Blocking removes the friendship and any pending friend requests between the two accounts, as well as their membership in each other's friend groups. While the block is active, and in both directions, neither user can send the other a friend request, find them in user search, see their comments, mention them, receive notifications about their activity, view their profile or see their posts in the Discover feed. Since messaging is reserved for friends, it is also cut off. The user can view and lift their blocks from the settings; lifting a block does not restore the removed friendship, requests or groups.

4.7 Reporting

The user may report, from the application or the website, a post, a comment or a user they can see, by choosing a reason (spam, harassment, inappropriate content, violence or other) and optionally adding details. After reporting, they are offered the option to block the user concerned.

Reports are reviewed by the Publisher, who may dismiss them, delete the reported post or comment, or delete the account of the user concerned, in accordance with sections 4.5, 4.9 and 7.

4.8 Notice of unlawful content

Any person, including without a Reminiscio account, may notify the Publisher of content they consider unlawful by writing to contact@reminiscio.com. The notice should include a sufficiently substantiated explanation of why the content is considered unlawful, the precise location of the content, such as the author's username and the date or a description of the post or comment, the name and email address of its author, except for notices concerning child sexual abuse material, and a statement confirming that its author believes in good faith that the information and allegations it contains are accurate and complete.

The Publisher acknowledges receipt of the notice, processes it in a timely, diligent and objective manner, and informs its author of the decision taken and of the available remedies.

4.9 Moderation decisions and remedies

When the Publisher removes or restricts access to content, or suspends or deletes an account, it informs the user concerned by email, unless prohibited by law, of the decision, the facts and circumstances on which it is based, and the provision of these Terms of Use or the legal basis invoked. The user may contest the decision by writing to contact@reminiscio.com within six months; the Publisher re-examines it and informs the user of the outcome. The user may also bring the matter before the competent courts.

5. Intellectual Property

All elements of the Service, including the logo, interface, text, code and design, are the exclusive property of the Publisher and are protected by intellectual property law. Any unauthorized reproduction, modification or exploitation is strictly prohibited.

6. Liability

6.1 Limitation of liability

The Service is provided as is. The Publisher makes reasonable efforts to ensure the availability and proper operation of the Service but does not guarantee uninterrupted availability. The Publisher cannot be held liable for indirect damages resulting from use of the Service.

6.2 Force majeure

The Publisher cannot be held liable in the event of force majeure, including technical failures, network interruptions or natural disasters.

7. Suspension and Termination

The Publisher reserves the right to suspend or delete a user account in the event of a violation of these Terms of Use, without prior notice in the event of a serious violation. The user is informed of the decision and its reasons in accordance with section 4.9. The user may delete their account at any time from the application settings, resulting in the deletion of their personal data in accordance with our privacy policy.

8. Changes to the Terms

The Publisher reserves the right to modify these Terms of Use at any time. Users will be informed of any substantial change. Continued use of the Service after a change constitutes acceptance of the new terms.

9. Applicable Law and Jurisdiction

These Terms of Use are governed by French law. In the event of a dispute, the parties agree to seek an amicable solution before any legal action. Failing that, the competent courts will be determined in accordance with applicable legal rules.
